If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
Course Content License
Permission is granted to access your user account within our website and view all courses you have purchased. Where permitted by the course, you may download or upload copies of the materials (information or software) on Pass In Training's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on Pass In Training’s web site;
- remove any copyright or other proprietary notations from the materials;
- transfer the materials to another person or “mirror” the materials on any other server; or
- allow any other person to access your account using your login information.
You are permitted to view all courses you have purchased on multiple devices, however by agreeing to these terms and conditions you are permitting us to monitor the IP Addresses from which you access the content. Where we believe more than one device is being used at the same time or have cause to believe you have shared your account with another person, we reserve the right to suspend your account immediately. We will restore your account 7 days after it is suspended for the first time. However should we be required to suspend your account a second time for the same offence, we will not restore your account or refund you in full or in part for any courses bought and not started or bought and part-completed.
We also reserve the right to report any instance of unauthorised sharing of our products to the ICAEW’s Professional Conduct Department. An adverse finding from the resulting investigation or a disciplinary hearing can result in a reprimand, fine or even exclusion from ICAEW as a provisional member.
All course items purchased are available for one exam sitting. All courses will expire after you have sat the examination. You will be able to re-purchase relevant content for a further sitting unless the course is part of our Pass Guarantee Scheme, in which case we will provide you with a discount code allowing you to receive a 100% discount on these products.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by Pass In Training at any time. Upon terminating your viewing of these materials or upon the termination of this license, you agree to destroy any downloaded materials in your possession whether in electronic or printed format.
Limitation of liability
Whilst we make all attempts to ensure the course materials available on Pass In Training’s website are accurate and do not contain errors, we do not guarantee all course content will not be free from error. You agree any liability for Pass In Training due to a material error in the course content or caused by their negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this Terms & Conditions will be limited to the cash receipts received from you. A material error is defined for the purposes of these Terms & Conditions as one which can directly be evidenced to have adversely affected your examination performance to an extent it cannot be disputed as being the main cause of a failed examination attempt.
Pass In Training shall not be liable for any indirect or consequential loss whether arising from negligence, breach of contract or otherwise.
Revisions and Errata
The materials appearing on Pass In Training’s web site could include technical, typographical, or photographic errors. Pass In Training does not warrant that any of the materials on its web site are accurate, complete, or current. Pass In Training may make changes to the materials contained on its web site at any time without notice. Pass In Training does not, however, make any commitment to update the materials.
Discounts Policy
We reserve the right to change the price of a course or offer discounts to the original sale price. Pass In Training does not extend its discounts or price changes retroactively to those who have already purchased the course before the discounted or price change was applied.
Refunds Policy
Pass In Training allows refunds only in cases where (i) the customer requests a refund within 24 hour of purchasing the relevant product and (ii) you have not commenced or viewed the course. You must email us within the first 24 hours requesting a refund. When the refund is processed, the purchased items will be removed from your Pass In Training account.
Pass Guarantee Scheme
With our Pass Guarantee Scheme, should you sit and fails to pass the Case Study exam for we will grant access to the course material covered by this scheme for all subsequent Case Study exam attempts. We will not charge a fee for this access. You must contact us via email in order and we will provide you with a discount code for you to purchase the course content for free.

Validity

Governing Law
The parties to this Agreement irrevocably submit to the exclusive jurisdiction of the English Courts for the determination of disputes arising under this Agreement. Any dispute arising out of this agreement between the parties will be referred to a single arbitrator to be appointed by mutual consent.
